Court adjourns Mbanefo’s N100m libel suit until Nov. 6

Justice Oluwatoyin Ipaye of an Ikeja High Court has adjourned until Nov. 6 a N100 million libel suit filed by Mr Louis Mbanefo, a Senior Advocate of Nigeria, against Independent Communications Network Ltd, a media company.
Mbanefo, 73, a professor of Maritime Law, is the son of Sir Louis Mbanefo, the first lawyer from Eastern part of the country and a former Justice of the Supreme Court.
He alleged that a story with the headline, “Judge stuns senior lawyer, Mbanefo, by denying him bail on self-recognition”, published in the May 5, 2015 edition of The News online magazine is defamatory.
The News Agency of Nigeria (NAN) reports that online magazine had alleged in its story that Mbanefo, had stood surety for another lawyer, Mr Luke Emejulu, at the X-Squad, Lagos Police Command, Ikeja, Lagos.
Following Emejulu’s failure to make an appearance in court, Mbanefo, according to th story, was arraigned before Magistrate Yewande Aje-Afunwa of an Ikeja Magistrates’ Court and charged with obstruction of justice.
Mbanefo was allegedly refused to be set free  on self-recognizance by Aje-Afunwa, but was instead slammed a bail of N500,000 with a surety in like sum.
Mbanefo, however, through his lawyer, Mrs Bibiana Orekyeh, in his N100 million suit against the media company, claimed that he was never arraigned at the Ikeja Magistrates’ Court and was abroad in London during the alleged proceedings.
He claimed that his pristine reputation had been damaged by the publication and had suffered damages.
In addition to the N100 million compensation, the lawyer is also seeking a declaration that the publication is defamatory to him and demanded an unreserved apology from the defendants.
He said the unreserved apology should be published in five national newspapers and requested a removal of the cached title of the publication online.
However, the defendants through their lawyer, Mr Benjamin Umudjoro, relied on the defence of justification and qualified privilege.
According to them, the publication is not malicious but is a direct report from their reporter.
They noted that Mbanefo, a public figure, is a role model to many young Nigerians and they (the defendants) are empowered by the Constitution of Nigeria to inform those that look up to the claimant of matters connected to him.
They noted that criminal matters and court proceedings are of public interest.
The defendants insist that Mbanefo is not entitled to N100 million damages, a unreserved apology or any other declaratory relief.
However, all parties involved in the suit have agreed an out-of-court settlement.

Court orders MTN to pay ex-Nigerian operations manager N4.8billion

The National Industrial Court of Nigeria (NICN), Akure Division, has ordered MTN Nigeria Communications Limited and MTN International, Mauritius, to pay its former Network Group Operations Manager, Mr Paul Odunewu, $13,419,728.54, £10,000 and N2,540,000 (totalling N4, 825,036,735.9) following wrongful termination of employment. Justice Oyejoju Oyewunmi made the order on Wednesday, September 27, 2017 following Odunewu’s suit challenging his 2006 termination and the deprivation of his entitlements including share options valued at $13,144,512.00. MTN Group Limited, South Africa; MTN Nigeria and MTN International, Mauritius were first, second and third defendants in the suit which lasted 10 years from the Lagos State High Court to the NICN. Justice Oyewunmi ordered that the sums be paid by the second and third defendants, “except the issue of costs which is to be paid by all the defendants.
” The judge ordered MTN to make the payments within 30 days following which the sums would appreciate at 21 percent interest per annum. In reaching judgment, the court agreed with the submissions of Odunewu’s counsel, Mr Kemi Balogun (SAN) that MTN unfairly imposed a restraint of trade on Odunewu, thus preventing him from working for a period. The judge upheld Mr Balogun’s submission that the evidence showed that Odunewu neither committed any serious, persistent breach of the provisions of the agreement or the company’s code, nor was ever summoned to a disciplinary committee or found guilty of any misconduct or non-performance.
Justice Oyewunmi observed, among others, that the defendants failed to controvert the testimony of a former MTN Chief Executive Officer, Mr Adrian Wood, regarding the offers made to Odunewu which persuaded him to quit his job in The United Kingdom and join MTN. Odunewu, a UK-based chartered engineer, was employed by MTN Nigeria in 2001. He said MTN pleaded with him to return home from the UK and help the company to develop its telecommunications in Nigeria. He averred that he was promised, among others, a Share Option, a long-term incentive scheme being developed by MTN. Odunewu said when he complained that the Share Option was not contained in his offer letter, MTN persuaded him to accept the job, adding that he would be entitled to the shares after three years.
Odunewu said he worked at MTN for over four years, and was responsible for the network’s outstanding achievements, which continues till date. The former manager said he was responsible for the company’s pre-paid and post-paid revenue, subscription, voucher management and real-time charging. Odunewu commenced the suit against the defendants in 2007 before the High Court of Lagos State, but in 2012, it was transferred to and began afresh at NICN which had exclusive jurisdiction. Trial commenced on January 29, 2014.

Man kills 55-yr-old mother, rips her womb open

A 55-year old woman identified as Josephine Igbineweka has been killed by her last child, Caleb Obasogie.
Caleb, aged 22, allegedly killed his mother because she refused to give him money.
The killing occurred around 8am at their residence at 31A, Iyamu Street, off Textile Mill Road, Benin City.
Witnesses said Caleb locked his mother in a room and stabbed her repeatedly with broken bottle until her intestines ripped out.
He reportedly dangled the intestines and his mother’s womb before neighbours before they could rush in to rescue her.
Neighbours said the deceased passed the night at a neighbour’s house because her son locked her out for not giving him the money he demanded from her.
Caleb is a final year student of the University of Benin (UNIBEN) while his late mother was a beer parlour operator in Benin.
Spokesman of the Edo State Police Command, DSP Moses Nkombe, confirmed the incident and disclosed that the suspect has been arrested by the police.

“The major reason we may have after the lectures commences is just that they must be paid before they can commence with the lectures.”
“As for the money the Government promised, the management would notify us if they have gotten the money because it’s one thing to pay and another thing to get the Alert. We just want to be sure we have gotten the alert. We really want to thank the two Governors they really exhibited the behavior of a good statesman. Even when they were provoked they never showed it,” he said.

57 years after independence: Nigeria still dancing naked in public – TUC

The Trade Union Congress of Nigeria (TUC) said Friday that 57 years after the nation’s independence, Nigeria was still “dancing naked” in the public to the full glare of the whole world while its roof is still on fire and challenge the nation’s leadership to see this year’s independence celebration as an opportunity to reposition the country.
President of the Congress, Comrade Bobboi Kaigama said in his Independence Day message that Nigerians must look at the reality in our country dispassionately, honestly and work to achieve a better Nigeria for our children.
He said: “ordinarily it should not be out of place if we roll out our drums today to celebrate this feat, but we cannot, because like they say “you don’t participate in a dance competition when your house is on fire.” Nigeria is dancing at the market square naked to the full glare of the whole world when our roof is on fire.”
According to him, over a 100-year after the north and south were amalgamated with the sole aim of complementing each other and the attainment of independence on in 1960, many had thought that progress and development would be rapid. Pointing out that this has not been so.
He said that as a progressive organisation, the “Trade Union Congress of Nigeria appreciates the fact that we have stayed together as a country. It is something to cheer about like I noted earlier but our staying together has been at the cost of innocent blood and outright violation of the fundamental rights of Nigerians.
“This day should remind us of our heritage, the vision and struggles of the founding fathers unfortunately some have had cause to question the rationale behind the quest for independence in the first place. Our tale is that of a conundrum with insurgencies, collapsed educational system, gross unemployment, ritual killing, cultism, prostitution/rape, mass emigration, de-industrialisation, tribalism and nepotism, inept leadership, environmental challenge, infrastructural decay, gender issues, badoo, kidnapping, yahooPlus, corruption and anti-graft, and a host of others.”
The Congress regretted that while Nigeria remain one of the 17 countries that attained independence in 1960, “Nigeria is not at par with many of these countries today even when they do not have one-tenth of what we have in terms of human and natural resources. Nature has been fair to Nigeria but Nigeria is not fair to itself.
“Our plight as a country beats the imagination of the world. Why? We have an ocean behind our house yet bath with spittle. The United State of America has enjoyed nationhood for over 250 years, yet still together with its components states. Politicians frustrate every effort to make our country healthier.
“How do we reconcile it that in a country where state governments claim they cannot pay ordinary N18, 000 national minimum a lawmaker who barely attends three sessions per week smiles home with over N30m per month? Isn’t it laughable that our lawmakers now compete with stand-up comedians, musical artists and professional dancers? If people fail to agitate under this circumstance then it means we are ill-fated.
“It is a good thing to have the I-CAN-DO-IT attitude but it is also wisdom to bring on board those who can help actualise your aspiration. At home and in diaspora are many Nigerians that have excelled in their businesses and contributed meaningfully in building the economies of host countries: Mr. Adebayo Ogunlesi is a Nigerian and he bought three foreign Airports through his private firm in six years; Mr. Philips Emegwali was christened the father of computer and Mr. Jelani Aliyu, the designer who produced General Motor (GM’s) most electrifying advanced technology vehicle, the Chevrolet Volt concept.
“Given the enormous wealth of human and natural resources that the Creator out of His magnanimity has bestowed to this country, we should not lack any basic need of life?  The pain we bear is a needless one.
“We challenge the leadership and Nigerians to see this year’s independence anniversary as a vintage opportunity to reflect on our polity, economy and society at large. We must all look at the reality in our country dispassionately, honestly and work to achieve a better Nigeria for our children.
“Life has become unbearable for majority of Nigerians. It is laughable that our leaders travel abroad, but do not replicate what they saw over there. Why will the country not be hit by recession when politicians spend 80% of their jumbo pay in buying properties in Dubai, UK, US, South Africa, etc?
“How can the education sector run a full session without strike when the children of politicians school abroad? The deplorable state of our roads is not a priority because they fly? When the system favours them there are no comments seen; but when it is otherwise they import arms and assemble youth to distabilise the system.
“The outcome of disenchantment is the crises and agitations we see everywhere. Our key functionaries and institutions must be made to work respectively and religiously like it is done elsewhere. Insecticides and deodorants have their roles. You cannot achieve result when you misapply the two liquids.
“The Congress, nay Nigerians are worried that the things we watch in films are now common sights. Recently the Nigerian Customs Services declared that no fewer than 2,500 pump Action guns have so far intercepted. For what purpose were they imported if not to throw the country into major crisis?
“What is the value of life in Nigeria? It is shameful that beyond the despicable situation the so-called elites have forced us into they still acquire guns and fanned the embers of disunity for us to kill ourselves. They take advantage of our frustrated children while theirs are in different parts of Europe spending our money. We are wiser now.
“Notwithstanding the myriad of challenges confronting the country, the Congress believes Nigeria can be great if the leadership wants. The world dismisses us but we must not dismiss ourselves.
“The world is pessimistic about the future of the most populated black nation but we must resolve to shame them. The country must not be allowed to snowball into a theatre of war and a ready-made market for arms and ammunitions. No. Never again! It is natural to despair but the Congress sees light at the end of the tunnel.
“We wish to appeal to the Federal Government to remember its “change mantra”. It makes no sense accusing and condemning the previous administrations for corruption only for the recovered money to be re-looted. Mere leaving a political party for the ruling party must not make anybody a saint.
“Anti-graft agencies and the judiciary must prosecute those who were caught with our money. We know corruption is fighting back but we are confident that the war over evil will always emerge victorious.
“The world is watching and waiting for the pride of Africa and most populated black nation to blossom. The Federal Government’s economic recovery plan must not fail.  No more excuses.”

Google ordered to shut down Catalonia referendum mobile app

Google must take down a mobile phone app that tells Catalan voters where they could vote for Sunday’s independence referendum, a judge has ordered.
The decree was issued by Mercedes Armas of the Superior Court of Justice of Catalonia, the magistrate who is leading the legal fight against the referendum, the Europa Press news agency reported on Friday.
It concerns the “On Votar 1-Oct’’ app on Google Play, which Catalan leader Carles Puigdemont publicised on Twitter two days ago.
Spanish authorities have already taken down hundreds of pro-referendum websites, in what is seen by secessionists as an attack on freedom of expression.

2nd Niger Bridge will be a reality — Osinbajo

The Federal Government has re-stated its resolve to complete work on the  second Niger Bridge as well as other federal projects in the South-East zone.
The Vice-President, Prof Yemi Osinbajo gave the assurance during a funeral mass for late Mrs Roseline Akabueze, the mother of Mr Ben Akabueze, the Director-General, Budget Office, Abuja at St Gabriel Catholic Church, Ifitedunu, Anambra State.
Osinbajo explained that the FG under President Mohammadu Buhari was committed to completing every federal project in the South East especially the second Niger Bridge.
According to him, “President Buhari went to China to negotiate with them about the second Niger Bridge and East-West road.
He said that everything have also been put in place to ensure the completion of Enugu-Onitsha expressway.
Osinbajo urged the National Assembly to consider and accommodate all the federal projects during their deliberations.
He re-stated that one of the cardinal principles of Buhari administration was fairness, which according to him has offered every political zone the opportunity to benefit from  his government.
Also speaking, Gov. Willie Obiano of Anambra recalled that Ifitedunu Community had benefited immensely from his administration, especially in the area of appointments.
Obiano urged the people to apply for the second phase of his N20 million community “Choose your Project” initiative, which is  geared toward developing every community simultaneously as well as empowering the youths.
Dignitaries present include the Minister of Labour, Dr Chris Nwabueze Ngige, Minister for Budget and National Planning, Sen. Udo Udoma.

Independence: NSCDC deploys 2,500 personnel in Niger

The Nigeria Security and Civil Defence Corps (NSCDC), Niger Command, on Friday said it had deployed 2, 500 security personnel to provide security during the nation’s 57th Independence celebrations in the state.
The Commandant of the Corps, Mr Philip Ayuba, disclosed this in an interview with the News Agency of Nigeria (NAN) in Minna.
Ayuba said that already plain cloth security personnel had been deployed to Minna, Suleja, Kontagora and Bida to beef up security ahead of the celebrations.
He said that the command was collaborating with sister security agencies and relevant stakeholders to ensure peaceful atmosphere before, during and after the festivities.
“We have also deployed security personnel to recreational centres, motor parks and public buildings to deal with any form of security threats,” he said.
The commandant called on parents to monitor the conduct of their children as anyone found fomenting trouble would be dealt with accordingly.
He appealed to residents of the state to provide the command with information that would lead to the arrest and prosecution of miscreants in their midst.

FIFA Bans Dele Alli For “Offensive And Unsporting” Gesture

Football ruling body FIFA has banned Nigerian born England midfielder Dele Alli for one international match following his middle-finger gesture during the World Cup qualifier against Slovakia.

Fifa also placed a fined 5,000 Swiss francs (£3,852) on the Tottenham player after it regarded the incident on 4 September as “offensive and unsporting”.
Alli will miss Thursday’s World Cup qualifier at home to Slovenia.
The 21-year-old will be available for the game against Lithuania on Sunday.
Alli said his gesture was aimed at former Spurs team-mate Kyle Walker during the 77th minute of the 2-1 win in Group F.
The incident occurred after Alli was body-checked by Slovakia defender Martin Skrtel, and referee Clement Turpin waved play on.
It initially appeared that Alli gestured towards the official, with whom he also had words when he was substituted in the 93rd minute.
A Fifa statement said: “Although the disciplinary committee was not convinced that the player directed the gesture at the referee, and regardless of whether it was allegedly directed at a team-mate, it did consider such gesture to be offensive and unsporting. Therefore it amounted to a violation of article 57 of the Fifa disciplinary code.”

French said he took the watch to a jewelers to be be cleaned and the jeweler asked where he got the watch from. When French told them Akon, the jeweler laughed in disbelief because he knew Akon.

Married Man In Trouble As Girlfriend Dies During Cex Marathon In His Home

A man simply identified as Tolu has landed in trouble after he had cex with an epileptic woman and she died in his room during a s-x romp in Lagos.

The incident happened at Oke Odo area of Lagos where both the woman and the man reside. The man has been arrested and detained at Oke Odo Police Division and he is now being charged for murder.
It was gathered that the suspect secretly invited the deceased when his wife was not around and engaged her in cex romp that lasted for hours.
However, during the romp, the lady started breathing heavily and became unconscious on the bed. The suspect quickly wore his clothes, came out and raised alarm which attracted the neighbours.
She was rushed to a hospital. However, before the doctors would attend to her she passed on. The doctors only certified her dead and her corpse was deposited at the morgue for autopsy report.
The incident was reported to the police and the suspect was arrested and detained at the police cell.
P.M.Express gathered that the deceased’s family was contacted, they confirmed that she had epilepsy and she might have died due to suffocation during the romp. However, the police insisted that the suspect was culpable until the report proved otherwise.
Meanwhile, both the police and the suspect were waiting for the report to know the next line of action. When our reporter visited Oke Odo Police Division, the suspect was still detained there.
The DPO was said to have gone to the State Command at Ikeja for CP briefing. However, a police source said the matter will be transferred to SCID Panti for further investigation.

“I Curse You Today!” Tonto Dikeh Fires Azuka Ogujiuba For Saying She Lied Against Her Ex-Husband

Controversial Nollywood actress turned woman of God, Tonto Dikeh may have taken a backseat when it comes to celebrity drama, but it appears she just got back on the road with it as she has called out popular journalist, Azuka Ogujiuba. Azuka Ogujiuba revealed shocking details about Tonto Dikeh’s crashed marriage. According to Azuka, Tonto Dikeh lied about being abused by her ex-husband, Olakunle Churchill, saying that she was the one who was abusive in the relationship.
She claimed to have video evidence to back up her claims and said she came to this conclusion after interviewing Tonto Dikeh and Churchill at different times.
Tonto Dikeh took to her Instagram page to blast Azuka and revealed more sordid details about her crashed marriage. She also alleged that Churchill paid Azuka 3million to interview him and lie against her. She cursed out Azuka saying she will never know peace until she forgives her.
Below is the epistle she wrote about the whole ordeal:
“Firstly Azuka You lured me into this interview. You used someone I respect a lot to convince me to talk about the marriage incidences. I finally succumbed to it because I felt that my story would help other women who faced the same issue of domestic violence. It was never orchestrated as u say.
Secondly, One of your staff suggested that I cover the scar on my leg. I told you that i was okay with the scar showing because it came as a result of domestic violence. – Furthermore, Azuka I told you several times about my faults in the whole incidence. I never hid any of it. I told you I broke things in his house as a response to the violence I faced. So why would you try and use that against me as if I did not openly admit and repent about it. As a matter of fact I have attached the text messages between us! Try and deny!
– Azuka you said yourself that Churchill offered you money to manipulate everything I said. Your assistant also admitted that Churchill offered her a large sum of money to manipulate the whole thing. You mentioned this in front of every body there! Your staff, your camera men, the make up staff, my team members and my brother. Don’t dare deny this! I have several KEY people who where present there.
Azuka you said that Churchill showed you a video of me destroying things. Azuka please release that video! Release everything that was captured on that cctv camera from the beginning of the fight to the end of it without a second or minute missing! Please do this and vindicate your artist since we know now that you manage him.
Azuka how dare you even say I lied! Where you there!? Where you present in any of the incidences that occurred!? Did you ever speak to any of my family that naturally would have taken sides with me just as his took sides with him. – When you called me for a second interview to counter his own interview what did I tell you? I said NO. That this is not a fight I want to entertain most especially because of my son. – Isn’t it funny that your boyfriend you sent to pick me from the airport is now flying around the country with Churchill! Coincidence?
You said that you went to Ghana for an event and decided to do a bit of investigative journalism? You lie. Azuka you where paid to go to Ghana!! Please don’t lie! Now if u where paid to go to Ghana, would common sense not tell you that the sources where also manipulated for your pleasure. – You said that Churchill refused an interview with you because he didn’t trust u then you later changed your story that Churchill and his people where the ones calling and begging you for an interview!!
You said I was out to destroy his image abi?!! Yet when you wanted me to say horrible things about him I told you that I wasn’t here for that. You asked me to tell you about his father not being Obasanjo! If I was truely out to destroy him I would have mentioned long long ago that his father was once a Gardner for Obasanjo who later became a preacher. (There you go)
– Furthermore, I was never once arrested! The domestic violence led to the neighbours calling the police! We where both taken down and both wrote our statement and both reported to the station every single day for three days. I went to my hotel to sleep every night until Churchill convinced me to drop the case. So I was amazed when I saw the video of the police lying against me. – Azuka The same Ghana that you went to is the same Ghana that my team and I visited with a reputable lawyer and confirmed my story! – Azuka I truely hope that 3 million has set a good foundation for your children. It is women like you that make this world a terrible place.
I once said that you where bribed a few months a go as a reply to a fan but my management went on my page to apologise in order to do damage control for you because of relationship one you obviously have no respect for. – Azuka I put it to you. You where successfully bribed! That is why you are going on TV talking all this. Azuka you told people I was on drugs! How dare you. Which reasonable man will suspect someone on drugs breastfeeding his child and would not take the child to the hospital for a check.
 Azuka I offered to fly you to Abuja to take me to any hospital so we could do a test. You bluntly refused and told me to please ignore all of this! – Azuka I
Azuka I could go on and on and on but here are a few things I wanted to say to you. Stay off my case and work on your journalism. You do not know the things I hide about your artist Churchill solely because of my son. Do no push me to reveal them. Stay away from me
– After 7 domestic violence incidences and miscarriages caused by domestic violence I curse you today! You will search for the same peace,wealth,love and happiness that you are trying to take away from me. Until I forgive you, you will not find. My God never sleeps.”

How Lady Jumped To Her Death From Bridge After Discussing Suicide Methods With Friend (Photos)

A top university student leapt to her death from a bridge after discussing suicide methods with a friend, an inquest heard today.
“Extremely bright” Lara Nosiru, 23, had taken some medication and class A drugs when she plunged off Clifton Suspension Bridge in Bristol in January this year.
She went there with fellow Bristol University student Kasumi Kishi, who told police she had hoped to convince Ms Nosiru not to kill herself.
Two days later Ms Kishi told friends over a pizza how the two women had discussed suicide methods and killing themselves together.
Fellow flatmate Alex Gough claimed Ms Kishi told the group that if someone wanted to die it was cruel to make them stay alive.
Flatmate Solene Rebibo said at the meal Ms Kishi “seemed comfortable” talking about suicide to Ms Nosiru’s friends.
CCTV footage showed the two women walking across the famous bridge shortly before 4pm on January 30 with Ms Nosiru occasionally stopping and looking over the edge.
When they reached the North Somerset side Ms Nosiru, from South Ockenden, Essex, twice tried to climb onto the wall above the gorge edge but Ms Kishi pulled her back down.
They two women then appeared to have a minor disagreement before Ms Kishi walked away and left her without looking back.
The security cameras showed Ns Nosiru having a final cigarette before climbing onto the wall and falling to her death.
The inquest heard that Ms Nosiru had suffered from depression for four years and took an overdose the night before her death.
Psychotherapist Dr Niklas Serning said he had seen Ms Nosiru every week for a year and she was “extremely bright” and would discuss the meaning of life at their hourly sessions.
He told the coroner: “She reported to me she had tried to kill herself.
“New Year and Christmas was a very sensitive time for her.”
He said Ms Nosiru wanted to give life “another try” and asked him to “make my life meaningful again”.
Asked if there was anything that would have made him think she was going to take her own life, he said: “Absolutely not.”
Dr. Harrowing said Ms. Kishi was not directly involved in Ms Nosiru’s death and she had taken a “deliberate action” to jump off the bridge.
But he said he couldn’t be sure beyond reasonable doubt that she had the mental intention to take her life that day.
He concluded: “She took her own life whilst under the influence of drugs.”’
